My first one was a Squier Strat that my grandmother probably regretted buying the second I plugged it into an amp. I&#8217;ve owned other brands since, plenty of them, but there&#8217;s almost always been at least one Fender in the mix. When I was performing live, I was overwhelmingly a Fender player. That brand shaped how I think about tone, about stage presence, about what &#8220;sounding right&#8221; even means.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That&#8217;s why watching the company&#8217;s recent legal actions involving Stratocaster-inspired guitars has been disappointing. Not because a company shouldn&#8217;t protect its intellectual property &#8211; it should. But because it raises a question that extends far beyond guitars, and far beyond Fender.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Every organization has different functions with different responsibilities. Legal protects rights. Finance protects resources. Product builds the future. Communications protects trust. The best decisions happen when all of them are in the room together, not when one function hands down a verdict and everyone else finds out from a press release.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Too often, organizations ask one question before sending a cease and desist: &#8220;Can we do this?&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That&#8217;s the wrong starting point. The better question is: &#8220;What offers the best outcome?&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sometimes those two questions produce the same answer. But not always.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Just because Legal has identified the correct legal response doesn&#8217;t necessarily mean it&#8217;s the best organizational response.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If someone is selling counterfeit products, intentionally misleading customers, or creating a genuine safety issue, legal action is likely completely appropriate. Protecting customers and protecting your intellectual property are legitimate responsibilities. But not every situation deserves the same response, and I want to believe that most of us know the difference the moment we see it. A knockoff sold as the real thing is one problem. A small builder making an homage is a different one entirely.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Before escalating, I&#8217;d ask a few questions.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Is this actually causing meaningful harm to our business?<\/li>\n\n\n\n<li>Which creates the greater risk: their product, or the public reaction to our response?<\/li>\n\n\n\n<li>Why are customers choosing them in the first place?<\/li>\n\n\n\n<li>Have we explored solutions that achieve the same objective without turning this into a public legal dispute?<\/li>\n\n\n\n<li>Is Communications sitting at the table with Legal before we make this decision?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">That last question matters more than ever. A cease and desist letter isn&#8217;t just correspondence between two companies anymore. It&#8217;s a Reddit thread, a YouTube video, a LinkedIn discussion, and a dozen screenshots shared across social media before lunch, most of them from guitar players who&#8217;ve spent decades being loyal to your brand and are now trying to figure out how they feel about that loyalty.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The audience is no longer just the offending party: it&#8217;s everyone watching. And they&#8217;re not evaluating the finer points of intellectual property law: they&#8217;re evaluating your brand.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As communicators, we sometimes forget that perception isn&#8217;t created by intent: it&#8217;s created by perception. A market leader sending legal notices to much smaller companies may have a strong legal argument. The public may still conclude something entirely different, and once that conclusion sets in, no legal brief walks it back.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That&#8217;s why I&#8217;d ask another question before sending the letter: what other options are there?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">If the objective is to protect the value of an iconic design, could we lead with authenticity instead of enforcement? Could we remind people why we&#8217;re the original? Could we collaborate with respected builders on limited projects? Could we help smaller manufacturers transition toward more distinctive designs? Could we turn a potential conflict into an opportunity to strengthen the entire community that helped make our brand iconic in the first place? <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Those ideas may or may not be the right answer. But they deserve to be part of the conversation before reaching for the most confrontational option available.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Stratocaster isn&#8217;t just another product. It&#8217;s one of the tools that helped shape modern popular music. Its influence extends well beyond the company that created it, into garages and studios and stages and bedrooms of twelve-year-olds who have no idea yet what they&#8217;re about to fall in love with.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That doesn&#8217;t mean Fender should abandon its intellectual property. It does mean that leadership carries different expectations. People expect more from market leaders. They expect confidence, they expect stewardship and they expect decisions that solve problems without unnecessarily damaging relationships.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At Narrativo, we often say that every organizational decision is also a communication. Legal decisions are no exception. Because the question isn&#8217;t simply whether you can protect your rights. It&#8217;s whether you can achieve the same objective while preserving the trust that took decades to earn.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Sometimes, the most successful legal strategy isn&#8217;t the one that wins the argument.
